1.Who we are & scope
Kayanda LLC ("Kayanda," "we," "us") is a Maryland limited liability company, registered since 2018, operating the Kayanda group of companies: Kayanda Capital (funding-preparation software, and planned or in-development consumer money products described below), Kayanda Property, Kayanda Emergency Housing (transitional housing placement services), Kayanda Private Security (protective services, by appointment), KAI — Kayanda AI Academy (online course and reseller licensing), and related programs including careers ("Earn") listings.
This Privacy Policy explains how we collect, use, share, and protect personal information when you visit kayandallc.com, contact us, request an appointment, apply to work with us, or use any Kayanda service. If a specific service provides its own privacy notice or written agreement, that document controls where it conflicts with this policy.
2.Information we collect
Information you provide directly
- Contact details — name, email address, phone number, company name, and the contents of messages you send us.
- Appointment requests — information you choose to include when requesting a consultation with any division.
- Business & financial documents (Kayanda Capital) — invoices, contracts, purchase orders, revenue documents, and business information you upload to prepare for funding.
- Course & license information (KAI) — enrollment details, payment records processed by our payment provider (we do not store full card numbers), course progress, Path Agent™ answers (stored locally in your browser unless you email them to us), and reseller license status.
- Money Agent™ answers & account information (Kayanda Capital consumer products) — if and when Flow, Cushion, Split, or Send become available, information you provide to check eligibility or use them, which may include income range, deposit and transaction history, gig or invoice payout history, identity-verification information (such as name, date of birth, and government ID) required to open an account under applicable law, and transaction data needed to process transfers, split payments, or a cash cushion.
- Housing services information (Emergency Housing) — information needed to assess eligibility and coordinate placement, which may include sensitive personal circumstances you choose to share.
- Security consultations (Private Security) — information you share in confidential consultations, governed additionally by non-disclosure agreements.
- Employment applications — résumés, work history, and related applicant information.
Information collected automatically
- Device and usage data such as IP address, browser type, pages viewed, referring pages, and timestamps.
- Cookie and similar-technology data as described in Section 6.
Please do not send Social Security numbers, full payment card numbers, passwords, or government ID numbers by email. If a service requires verified identity or payment, we will provide a secure method.
3.How we use information
- To respond to inquiries and schedule appointments (we operate by appointment only).
- To provide, operate, and improve our services and website.
- To prepare deliverables you request — for example, organizing documents into funding-readiness packages (Capital) or coordinating housing placement (Emergency Housing).
- To evaluate employment or contractor applications.
- To maintain safety, security, and the integrity of our systems.
- To comply with legal obligations, contracts, and government program requirements.
- With your consent, for any purpose described at the time of collection.
We do not sell personal information, and we do not use your uploaded business documents to train artificial-intelligence models for third parties.
4.Division-specific practices
Kayanda Capital
Documents you upload remain your property. They are used solely to assess funding readiness, assemble application packages, and — only at your direction — share prepared materials with capital providers you approve. Kayanda is not a lender and does not make credit decisions.
If and when Kayanda Flow, Cushion, Split, or Send become available, any deposit-taking, money-transmission, card-issuing, or lending activity will be performed by a licensed bank, money transmitter, lender, or card issuer, and your information will also be handled under that partner's own privacy notice. Where those products involve financial account information, we intend to treat that information consistently with the Gramm-Leach-Bliley Act's privacy and safeguarding expectations, including limiting use of nonpublic personal financial information to servicing your account, preventing fraud, and complying with law, and providing a way to limit sharing with nonaffiliated third parties for their own marketing to the extent required by law. Identity-verification information collected to open an account (a "Customer Identification Program," as required of U.S. financial institutions) is used only to verify identity, prevent fraud, and meet legal requirements, and is shared with the issuing bank, processor, and applicable regulators as required by law.
Kayanda Emergency Housing
Placement services may require sharing necessary information with Montgomery County DHHS and program partners to coordinate services you request. We share the minimum required for placement and program compliance, and handle information about personal circumstances with heightened care.
Kayanda Private Security
Consultations are confidential by default and typically governed by mutual non-disclosure agreements before substantive details are discussed. We do not publish, disclose, or confirm client identities. Information is shared only as required to deliver agreed services through licensed professionals, or as required by law.
Kayanda Property & Careers
Property inquiries and employment applications are used only for the purpose submitted and retained per Section 7.
5.When we share information
We share personal information only:
- At your direction — e.g., sending your prepared funding package to a capital provider you approve.
- With licensed financial partners — if you use Kayanda Flow, Cushion, Split, or Send once available, the bank, money transmitter, lender, card issuer, or payment processor that actually provides the account, transfer, or financing needs your information to open the account, move the money, screen for fraud/sanctions, and meet their own regulatory obligations.
- With service providers who process data on our behalf (hosting, email, document storage) under confidentiality obligations.
- With government programs where required to deliver services you request (e.g., county housing programs).
- For legal reasons — to comply with law, valid legal process, or to protect the rights, safety, and property of Kayanda, our clients, or others.
- In a business transfer — if a division is reorganized, merged, or sold, subject to this policy's protections.
We do not sell or rent personal information to data brokers or advertisers.
6.Cookies & analytics
Our site uses only the cookies and similar technologies needed to operate and understand basic usage (such as page performance and aggregate traffic). We do not run third-party advertising trackers. You can control cookies through your browser settings; disabling them may affect site functionality. If we adopt analytics tools that collect additional data, we will update this policy first.
7.Data retention
- Inquiries & appointment requests — retained as long as needed to respond and for a reasonable period thereafter.
- Client engagement records — retained for the duration of the engagement plus the period required by law, contract, insurance, or government program rules.
- Uploaded business documents (Capital) — retained while your account or engagement is active; deleted or returned on verified request, except where retention is legally required.
- Course & licensing records (KAI) — enrollment, payment, and license records retained for tax and commercial recordkeeping periods (generally seven years).
- Financial account & transaction records (Flow, Cushion, Split, Send) — if these products become available, records needed for account servicing, fraud prevention, and financial recordkeeping laws are retained for the period required by our licensed partner's regulator (commonly five years or more under bank recordkeeping and anti-money-laundering rules), even after an account is closed.
- Applicant records — retained for a reasonable recruitment period unless you ask us to delete them sooner.
8.How we protect information
We use administrative, technical, and physical safeguards appropriate to the sensitivity of the information, including access limited to personnel who need it, encrypted transmission where supported, and confidentiality obligations for staff and vendors. No method of transmission or storage is perfectly secure; we cannot guarantee absolute security, and we ask that you use the secure channels we provide for sensitive material.
9.Your privacy rights
Depending on where you live, you may have rights under laws such as the Maryland Online Data Privacy Act, the California Consumer Privacy Act, or other state and international privacy laws, including the right to:
- Know what personal information we hold about you and request a copy;
- Correct inaccurate personal information;
- Request deletion of personal information, subject to legal exceptions;
- Opt out of sale, sharing for targeted advertising, or certain profiling (we do not sell personal data or run targeted advertising);
- Not be discriminated against for exercising these rights.
To exercise any right, contact us using Section 13. We will verify your identity before acting and respond within the time required by applicable law. If we decline a request, we will explain why and how to appeal where the law provides an appeal.
10.Children's privacy
Our services are intended for adults and businesses. We do not knowingly collect personal information from children under 18. If you believe a minor has provided us personal information, contact us and we will delete it.
11.Third-party services & links
Our site may link to third-party services (for example, payment, scheduling, or mapping providers). Their privacy practices are their own; review their policies before providing information. References to third-party companies on our site do not mean those companies process your data on our behalf unless stated.
12.Changes to this policy
We may update this policy from time to time. The effective date above reflects the latest revision. Material changes will be posted on this page, and where required by law we will provide additional notice. Continued use of our services after changes take effect constitutes acceptance of the revised policy.
